This End User License Agreement ("EULA") is a legal agreement between you ("User") and Horizon Tech Development, LLC ("Company," "we," "our," or "us") governing your use of the RiderRadar mobile application and related services (the "App").
By installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this EULA.
You retain ownership of content you create or upload ("User Content"). You grant us a limited license to store, process, and display User Content solely to operate and improve the App.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
RiderRadar offers optional location-based features. You control whether your location is shared and with whom.
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference.
You must provide accurate account information and safeguard your credentials. You must be at least 16 years old to use RiderRadar.
Payments for premium features are processed by the Apple App Store or Google Play and are subject to their billing and refund policies.
You may terminate this EULA at any time by deleting your account or uninstalling the App. We may suspend or terminate access if you violate this EULA or misuse the App.
RiderRadar is a social and location-based application. You acknowledge that riding activities involve inherent risks. You assume all risks associated with your use of the App and interactions with other users.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Horizon Tech Development, LLC from claims arising out of your use of the App or violation of this EULA.
This EULA is governed by the laws of the United States and the State in which Horizon Tech Development, LLC is registered, without regard to conflict of law principles.
We may update this EULA from time to time. Continued use of the App constitutes acceptance.
