RiderRadar End User License Agreement (EULA)

This EULA is a legal agreement between you ("User") and Horizon Tech Development, LLC ("Company," "we," "our," or "us") regarding the RiderRadar mobile application and related services (the "App").
By installing, accessing, or using RiderRadar, you agree to be bound by this EULA. If you do not agree, do not use the App.
1. License Grant
We grant you a personal, non-exclusive, non-transferable, revocable license to use RiderRadar on your devices for personal, non-commercial purposes, subject to the terms of this EULA.
2. Restrictions
You agree not to:
• Reverse engineer, decompile, or disassemble the App
• Use RiderRadar to harass, abuse, threaten, or harm others
• Interfere with or disrupt servers, networks, or other users' use of the App
• Share another user's location without their explicit consent
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Remove, alter, or obscure any proprietary notices from the App
• Use automated systems (bots, scrapers) to access the App
• Impersonate another person or entity
• Upload viruses, malware, or other malicious code
3. User Content
a. Ownership
You retain ownership of all messages, images, and other content you create or upload ("User Content").
b. License to Us
You grant us a limited, worldwide, non-exclusive license to store, transmit, display, and process your User Content solely to provide and improve the Services.
c. Responsibility
You are solely responsible for your User Content and the consequences of posting it. You represent that you have all necessary rights to your User Content.
d. Prohibited Content
You may not post User Content that:
• Violates any law or regulation
• Infringes intellectual property rights
• Contains hate speech, threats, or harassment
• Is sexually explicit or pornographic
• Promotes violence or illegal activities
4. Location Data and Privacy
a. Location Sharing
RiderRadar requires location permissions to function. You control whether to share your real-time location.
b. Location Privacy
• Location is shared only with authorized friends, groups, or RiderBeacon public map pins if enabled
• You can enable Ghost Mode to hide your location
• You can enable Location Scrambling for approximate location sharing
• You can disable location sharing at any time in Settings
c. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into this EULA.
5. Account Registration and Security
a. Account Creation
You must provide accurate, current, and complete information during registration.
b. Account Security
You are responsible for:
• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
c. Age Requirement
You must be at least 13 years old to use RiderRadar. Users under 18 require parental consent.
6. Premium Services & Payments
a. Premium Features
If you purchase premium features (RiderBeacon Premium, etc.):
• Payments are processed by Apple App Store or Google Play
• All billing is subject to their terms and refund policies
• Subscriptions auto-renew unless cancelled
b. Refunds
Refund requests must be made through the App Store or Google Play according to their policies.
c. Changes to Pricing
We reserve the right to change pricing for premium features with advance notice.
7. Termination
a. By You
You may terminate this agreement at any time by:
• Deleting your account through Settings → Data & Privacy
• Uninstalling the App from your device
b. By Us
We may suspend or terminate your account if you:
• Violate this EULA or our Privacy Policy
• Misuse the service or harm other users
• Engage in fraudulent or illegal activities
• Fail to pay for premium services
c. Effect of Termination
Upon termination:
• Your license to use the App ends immediately
• Your account data will be deleted according to our Privacy Policy (30-day grace period)
• You must cease all use of the App
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability
• Freedom from errors, bugs, or viruses
We do not warrant that:
• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• Any errors will be corrected
• The App is free from harmful components
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HORIZON TECH DEVELOPMENT, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
a. Indirect, Incidental, or Consequential Damages
Including but not limited to:
• Loss of profits, data, or goodwill
• Service interruption
• Computer damage or system failure
b. Direct Damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
c. Specific Exclusions
We are not liable for:
• Accidents, injuries, or damages arising from use of the App
• Motorcycle accidents or incidents during rides
• Loss of data or unauthorized access beyond our reasonable control
• Actions of other users
• Third-party services (maps, hosting, etc.)
10. Indemnification
You agree to indemnify, defend, and hold harmless Horizon Tech Development, LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
• Your use of the App
• Your violation of this EULA
• Your violation of any rights of another party
• Your User Content
11. Dispute Resolution
a. Governing Law
This EULA is governed by the laws of the United States of America and the State of [Your State], without regard to conflict of law principles.
b. Arbitration
Any disputes arising from this EULA shall be resolved through binding arbitration, except:
• Small claims court actions
• Injunctive relief for intellectual property violations
c. Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions.
12. Modifications to EULA
We may update this EULA from time to time. When we make significant changes:
• We will notify users through the App
• You will be asked to review and accept the updated EULA
• Continued use after changes constitutes acceptance
13. Intellectual Property
a. Our Rights
RiderRadar, including all content, features, and functionality, is owned by Horizon Tech Development, LLC and protected by copyright, trademark, and other intellectual property laws.
b. Trademarks
"RiderRadar," the RiderRadar logo, and other marks are trademarks of Horizon Tech Development, LLC. You may not use them without our written permission.
14. Third-Party Services
The App integrates with third-party services (Firebase, Google Maps, etc.). Your use of these services is subject to their respective terms and privacy policies.
15. Export Control
You agree to comply with all applicable export and import laws and regulations.
16. Severability
If any provision of this EULA is found to be unenforceable, the remaining provisions will remain in full effect.
17. Entire Agreement
This EULA, together with our Privacy Policy, constitutes the entire agreement between you and Horizon Tech Development, LLC regarding the App.

19. Acknowledgment
By using RiderRadar, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy.
